These terms govern your use of bmescrow.com. By creating an account or funding a deal you accept them in full. They are written to be read, not to hide behind length.
1. What BM Escrow is
BM Escrow is a neutral escrow service for cryptocurrency payments between two trading parties. We hold USDT sent by a buyer until the conditions of a deal are met, then release it to the seller less the platform fee. We are not a party to your trade, not a broker, not an exchange, and not a bank. We do not verify the underlying goods or services beyond the evidence submitted to us in a dispute.
2. Eligibility
You must be at least 18 years old and legally able to enter contracts. You must not be located in, or acting on behalf of anyone in, a jurisdiction subject to comprehensive sanctions, and you must not appear on any applicable sanctions list. You are responsible for ensuring your use of the platform is legal where you live.
3. Accounts
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. One person or business may not operate multiple accounts to evade limits, fees or restrictions. Notify us immediately of any suspected unauthorised access.
4. No identity verification
BM Escrow operates without KYC. We do not request identity documents to open an account or to fund a deal. We do monitor on-chain activity and may suspend a deal or an account where transactions appear connected to sanctioned or illicit addresses; funds already in escrow are returned to their origin in that case.
5. Escrow and deposits
Deposit addresses displayed on a deal are the only valid destinations for that deal. You are solely responsible for sending the correct asset, on the correct network, in the correct amount. Funds sent on the wrong network, to a wrong address, or in an asset we do not support may be permanently unrecoverable, and we accept no liability for such losses.
Funds held in escrow are not deposits, earn no interest, and are not insured or protected by any deposit guarantee scheme.
6. Fees
The platform fee is 2% of the deal amount for deals under 5,000 USDT and 5% for deals of 5,000 USDT and above, unless a different rate is displayed on the platform at the time the deal is created. The fee applicable to a deal is shown before funding and is deducted at release. Blockchain network fees are separate and are not charged by us.
7. Release of funds
Funds are released to the seller when the buyer releases them, when an auto-release period configured by the platform expires after delivery is marked, or when an administrator resolves a dispute in the seller's favour. Releases are executed on a public blockchain and are final and irreversible once broadcast. Payouts above the platform's automatic limit require manual review and may be delayed.
8. Disputes
Either party may dispute a funded deal before release, which freezes the balance. Both parties agree to submit evidence promptly and in good faith. The administrator's decision on the allocation of escrowed funds is final and binding as between the parties for the purposes of releasing escrow. Nothing in this clause limits any right you may have to pursue your counterparty separately.
9. Prohibited use
You may not use BM Escrow for money laundering, terrorist financing, sanctions evasion, fraud, theft, extortion, trading in stolen data or credentials, weapons, controlled substances, child sexual abuse material, human trafficking, or anything else illegal in your jurisdiction or ours. We may freeze funds, refuse a payout, close an account and report to the relevant authorities where we reasonably suspect prohibited use.
10. Suspension and termination
We may suspend or terminate access where we reasonably believe these terms have been breached, where required by law, or where necessary to protect the platform or its users. Where funds are held for a terminated account, we will return them to their lawful owner subject to compliance checks and any dispute in progress.
11. Liability
The service is provided as-is. To the maximum extent permitted by law, our aggregate liability arising from any deal is limited to the platform fee we charged on that deal. We are not liable for the acts or omissions of your counterparty, for blockchain network failures, reorganisations or congestion, for losses caused by you sending funds incorrectly, or for indirect or consequential loss including lost profits.
12. Changes
We may update these terms and the published fees and thresholds. Changes apply to deals created after the change; a deal is governed by the fee shown when it was created. Continued use after a change constitutes acceptance.
